PROCEDURAL HISTORY/SUMMARY:

The parents filed a due process complaint on February 4, 2019. The Hearing Officer was appointed on February 6, 2019. A prehearing conference was set for February 15th, where the issues were set forth and a hearing date was set for early April. The parties requested an extension of the mailing date at the end of March, which was granted, and a new hearing date was set for early May. On April 25th, the attorney for the parents contacted the Hearing Officer via email to withdraw the Parent’s request for due process

ISSUES:

1. Was the Student denied FAPE by the West Hartford Board of Education (Board) for the 2017-2018 and 2018-2019 school years, including ESY for 2018 and 2019?

2. If the Student was denied FAPE, is placement at the Quaker Lane School appropriate for the Student for the 2018-2019 school year and is the Board responsible for the costs associated with this placement?

3. Is the Student entitled compensatory education and/or to any other relief as deemed appropriate by the Hearing Officer?

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
