ISSUES:

1. Did the District fail to provide the Student with FAPE for the 2017-18 school year?

2. Did the District fail to provide the Student with FAPE for the 2018-19 school year?

3. If the District failed to provide the Student with FAPE, what remedies should be ordered?

4. To the extent that requested remedies include transfer to other programs, are those programs appropriate for the Student?

SUMMARY AND PROCEDURAL HISTORY:

Case 19-0324 was commenced by the Parent by request received by the Board on January 23, 2019. The case involved disciplinary matters and was thus determined to be subject to the expedited procedural requirements provided by law. A prehearing conference was held on January 25, 2019. At the prehearing conference, it was determined that hearings were required to be held by February 20, 2019 and the decision date was determined to be March 6, 2019. No hearing dates were set as the hearing officer was advised that the matter was being withdrawn by the Parent at this time.

On January 25, 2019, the undersigned hearing officer received an email from the attorney for the Parent that the matter was being withdrawn at this time and should therefore be dismissed without prejudice.

FINAL DECISION AND ORDER:

The matter is dismissed without prejudice.
