ISSUES:
1. Did the board offer an appropriate program for the 2016-17, 2017-2018, and 2018-2019 school years, including the 2017 and 2018 extended school years?
2. If not, is placement at the Franklin Academy the appropriate program for the Student for the 2018-19 school year and should the board be ordered to place the Student at Franklin Academy for the 2018-19 school year and reimburse the Parents for any tuition expended?
3. Is the Student entitled to compensatory education?
PROCEDURAL HISTORY/SUMMARY:
The Parents brought the initial Due Process Complaint and Hearing Request on January 29, 2019. The Hearing Officer was appointed on January 30, 2019. A Prehearing Telephone Conference took place on February 13, 2019.
The initial hearing took place on April 3, 2019. The Parents requested a thirty day extension of the mailing date, which was granted by the Hearing Officer. The hearing was continued to May 10, 2019.
On May 7, 2019, the Parents’ attorney notified the Hearing Officer that the parties had settled the matter and that the Parents were withdrawing their request for hearing with prejudice.
FINAL DECISION AND ORDER:
The matter is DISMISSED
