ISSUES:
1. Is the Asep Program, a segregated program, at Bristol Eastern High School the least restrictive environment for the Student?
2. If the Asep Program is not the least restrictive environment for the Student, is North East Middle School an appropriate placement?
PROCEDURAL HISTORY/SUMMARY:
The Parent initiated this special education due process case on 1/8/19 and this Impartial Hearing Officer was assigned to this case on same date. A Prehearing Conference was convened on 1/14/19. The Parent appeared on behalf of the Student and Attorney Linda Yoder appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case was 3/22/19. An evidentiary hearing was scheduled for 2/26/19.
On 2/12/19, The Parent reported to the Hearing Officer that she would like to withdraw the subject due process complaint since the parties finalized a settlement agreement.
ORDER:
The matter is DISMISSED with prejudice.
