ISSUES:

1. Did the Board offer an appropriate program for the 2016-2017, 2017-18, 2018-19 school years, including the 2018 and 2019 extended school years?

2. If not, is placement at Fusion the appropriate program for the Student for the 2018- 2019 school year and should the Board be ordered to place the Student at Fusion for the 2018-19 school year?

3. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parent filed the Due Process Complaint and Request for Hearing on March 20, 2019. The Hearing Officer was appointed on March 22, 2019. The same day, the Board notified the Hearing Officer that the parties had participated in a mediation and had reached an agreement that was in the process of being finalized. On April 16, 2019, the Parent’s attorney reported to the Hearing Officer that the parties had finalized their agreement and that the Parent was withdrawing the Due Process Complaint with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
