ISSUES:
The following issues were identified for determination at the hearing:
1. Did the Board provide the Student a Free Appropriate Public Education (FAPE) during the 2017-18 School Year, including ESY 2017?
2. Did the Board commit a procedural violation by refusing to consider an out of district placement during the May 2018 PPT meeting and if so, did the violation result in loss of educational opportunity for the Student?
3. Did the Board commit a procedural violation by preventing Dr. Tagliarena from participating in the May 2018 PPT meeting and if so, did the violation result in loss of educational opportunity for the Student?
4. Did the Board propose an IEP that was calculated to provide the Student with FAPE for the 2018-19 School Year, including ESY 2018?
5. Is Villa Maria School an appropriate placement?
6. Is the Student entitled to compensatory education for denial of FAPE for the 2017-18 School Year including ESY 2017?
7. Is the Student entitled to reimbursement for tuition and transportation for denial of FAPE for the 2018-19 School Year including ESY 2018?
8. Should the Student be prospectively placed at Villa Maria School, including for summer services?
9. Did the Board provide the Student a Free Appropriate Public Education (FAPE) pursuant to Section 504 of the Rehabilitation Act during the 2017-18 School Year, including ESY 2017?
PROCEDURAL HISTORY:
The Student initiated this special education due process case on December 21, 2018. This Impartial Hearing Officer was assigned to the case on December 26, 2018. A Prehearing Conference was convened on January 15, 2019. Attorney Meredith Braxton appeared on behalf of the Student and Attorney Abby Wadler appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is March 6, 2019. An evidentiary hearing was scheduled for February 22, 2019, March 13, 2019 and March 18, 2013 . The hearing of February 22, 2019 was cancelled by the Hearing Officer.
On March 6, 2019 the Student reported that the matter had been resolved and requested that the matter be dismissed.
FINAL DECISION AND ORDER:
The Student’s request for dismissal is granted. The case is hereby dismissed.
