ISSUES:
1. Did the Board fail to promptly identify and evaluate the Student as eligible for Special Education?
2. If so, is the Parents’ unilateral placement to Woodhouse Academy appropriate?
3. If Woodhouse Academy is appropriate, should the Board be required to financially support the Student’s placement at Woodhouse Academy?
PROCEDURAL HISTORY/SUMMARY:
The Parents filed the Due Process Hearing Complaint on December 7, 2018. The Hearing Officer was appointed on December 12, 2018. The initial Pre-Hearing conference was held on January 7, 2019. A second prehearing conference was scheduled for January 29, 2019 to allow for the PPT meeting regarding eligibility to be held on January 24, 2019. The PPT was postponed. Ultimately, the Pre-Hearing conference was held on March 4, 2019. A hearing was scheduled for April 23, 2019. The mailing date was extended to May 24, 2019. The Parents withdrew their complaint with prejudice on April 23, 2019.
FINAL DECISION AND ORDER:
The matter is DISMISSED with prejudice.
