ISSUES:

1. Does the District’s proposed placement for the 2018-19 school year constitute a denial of FAPE?

2. If so, is the Student’s current placement an appropriate one?

3. If so, should the District be ordered to maintain the Student’s current placement?

SUMMARY AND PROCEDURAL HISTORY:

Case 19-0254 was commenced by the Parents by request received by the Board on November 27, 2018. A prehearing conference was held on December 4, 2018. At the prehearing conference, hearing dates were set for January 25, 2019; January 31, 2019 and February 1, 2019 and the decision date was determined to be February 4, 2019. The hearing dates were later cancelled and the decision date was extended to April 11, 2019.

On March 5, 2019, the undersigned hearing officer was advised by the attorney for the Parents that the parties had reached a settlement in the case and the matter should therefore be dismissed with prejudice.

FINAL DECISION AND ORDER:

The matter is dismissed with prejudice.
