ISSUES:
1. Did the Board provide Student with FAPE during the 2018-2019 school year, and 2018 extended school year period?
2. If the Board has not provided a free appropriate public education, then is the Eagle Hill School program the appropriate program for the Student, for the 2018-19 school year and should the Board be ordered to place the Student at Eagle Hill School for the 2018-19 school year?
PROCEDURAL HISTORY/SUMMARY:
The Parents filed the Due Process Complaint and Request for Hearing on December 31, 2018. The Hearing Officer was appointed on January 3, 2019. A Prehearing Conference was held on January 16, 2019. A hearing date was scheduled for March 14, 2019. The mailing date was March 15, 2019. On March 12, 2019, the Parents requested an extension of the mailing date and were granted a one-month extension until April 15, 2019. On April 10, 2019, the Parents through counsel indicated that the Parents were withdrawing their Due Process Request for Hearing with prejudice.
FINAL DECISION AND ORDER:
The matter is DISMISSED with prejudice.
