ISSUES:

1. Did the Board offer a free and appropriate program for the 2018-19 school year?

2. If not, is the Student entitled to either reimbursement or a speech and language therapist?

PROCEDURAL HISTORY/SUMMARY:

The Mother filed the Due Process Complaint and Request for Hearing on October 12, 2018. This Hearing Officer was appointed on October 16, 2018, and a Prehearing Conference was conducted on November 15, 2018. Hearing dates were scheduled for January 3, 7, and 8, 2019. The Board filed a Motion to Dismiss on December 12, 2018, and Counsel for the Parents filed an appearance on December 12, 2018, and further notified the Hearing Officer that the parents will be withdrawing the Due Process Request for hearing without prejudice.

FINAL DECISION AND ORDER:

The Boards Motion to Dismiss is moot as the parents have withdrawn their case and the matter is DISMISSED without prejudice.
