ISSUES:

1. Whether the Board offered an appropriate program for the 2016-2017, 2017-2018, and 2018-2019 school years including the 2017 and 2018 extended school years?

2. Whether compensatory education should be awarded as a remedy?

PROCEDURAL HISTORY/SUMMARY:

The Parents, through counsel, filed a Due Process Complaint and Request for Hearing on September 20, 2018. The Hearing Officer was appointed on September 24, 2018. A Prehearing Conference was held on October 10, 2018, and the hearing was noticed for January 10, 2019. On January 4, 2019, the parties requested an extension until February 9, 2019 to engage in a second mediation session, which was granted by the Hearing Officer. On January 29, 2019, the Parents withdrew their Due Process Complaint without prejudice.

FINAL DECISION AND ORDER:

In light of the above, the matter is DISMISSED.
