ISSUES:
1. Did the Board offer an appropriate program for the 2016-2017 school year and extended school year?
2. Did the Board offer an appropriate program for the 2017-2018 school year?
3. If either 1 or 2 are in the negative, is Westport Day School appropriate?
4. If Westport Day School is appropriate, should Parents be reimbursed for their educational related expenses for the Student’s placement at Westport Day School?
PROCEDURAL HISTORY/SUMMARY:
The Parents filed the Due Process Complaint and Request for Hearing on September 11, 2018. The Hearing Officer was appointed on the same day and conducted a Prehearing Conference on September 24, 2018. Hearings were conducted on November 19, 2018 and December 18, 2018. The mailing date of the Final Decision was extended at the request of the Board on December 21, 2018 to add additional hearing dates. On December 18, 2018, the Parent’s attorney reported to the Hearing Officer that the parties had come to an agreement and that the Parents were withdrawing the Due Process Complaint with prejudice.
FINAL DECISION AND ORDER:
The matter is DISMISSED with prejudice.
