ISSUES:

1. Was an appropriate program offered to the Student by the Farmington Board of Education for the 2016-2017, 2017-2018 and 2018-2019 school years?

2. If the Student was denied FAPE, is placement at Options appropriate for the 2018-2019 school year and is the District responsible for any or all costs related for this placement?

3. Is the District also responsible for costs outside of the regular tuition, including evaluations, counseling services and/or reading programs from the year 2017 to present?

4. Is the Student entitled to compensatory education, including placement at Options for the 2019- 2020 school year through the 2020-2021 school year?

5. Is the Student entitled to any other relief as determined to be appropriate by the Hearing Officer?

PROCEDURAL HISTORY/SUMMARY:

The Parents filed the Due Process Complaint and Request for Hearing on August 22, 2018. The Hearing Officer was appointed on August 23, 2018. A Prehearing Conference was held on August 29, 2018. The parties agreed on several hearing dates in November and the parties notified the Hearing Officer that negotiations were ongoing. The Hearing Officer was notified by the attorney for the Parents via email on October 17, 2018 that a settlement had been reached and the Parents were withdrawing their request for a Due Process Hearing.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
