ISSUES:

1. Did the Board offer an appropriate program for the 2015-2016, 2016-2017, 2017-2018 school years including the 2016 and 2017 extended school years?

2. If not, is placement at Haddam Killingworth Middle School the appropriate program for the Student for the 2018-2019 school year and should the Board be ordered to place the Student at Options School for the 2018-2019 school year?

3. Is the Student entitled to compensatory education?

PROCEDURAL BACKGROUND:

Counsel for the Student filed this Request for Due Process Hearing on August 24, 2018. The Hearing Officer was assigned on August 29, 2018. A Prehearing Conference was scheduled, and held on September 6, 2018, at which hearing dates were set. Counsel reported that mediation had been scheduled for this matter and requested extensions of time to attempt to reach a settlement. A hearing date was set by agreement for October 24, 2018. On October 3, 2018, Counsel for the Student informed the Hearing Officer in writing that they had reached a settlement of the matter, and the student's claims have been withdrawn with prejudice.

FINAL DECISION AND ORDER:

The case is DISMISSED without prejudice.
