ISSUES:

1. Did the District fail to provide the Student with FAPE for the 2016-17 and 2017- 18 school years?

2. Did the District fail to formulate an IEP which would provide the Student with FAPE for the 2018-19 school year?

3. If the District has failed to provide FAPE, is the Spire School an appropriate placement for the Student?

4. If the District has failed to provide FAPE for previous years, should the Student be provided with compensatory education?

SUMMARY AND PROCEDURAL HISTORY:

Case 19-0068 was commenced by the Parents by request received by the Board on August 2, 2018. A prehearing conference was held on August 9, 2018. At the prehearing conference, hearing dates were set for October 1, 2018; October 3, 2018 and October 4, 2018 and the decision date was determined to be October 16, 2018. On September 24, 2018, the undersigned hearing officer was advised by the attorney for the Parents that the parties had reached a settlement in the case and the matter should therefore be dismissed with prejudice.

FINAL DECISION AND ORDER:

The matter is dismissed with prejudice.
