ISSUES:

1. Did the Board deny the Student a FAPE from 2016 to 2018?

2. Was the IEP dated 5/29/18 insufficient to provide the student with a FAPE?

3. If the Board denied the student a FAPE from 2016 to 2018, is a private school placement with therapeutic components appropriate?

4. If the Board denied the student a FAPE from 2016 to 2018, is compensatory education appropriate?

PROCEDURAL HISTORY/SUMMARY:

The Student initiated this special education due process case on 9/17/18 and this Impartial Hearing Officer was assigned to this case on said date. A Prehearing Conference was convened on 9/27/18. Attorney Jillian Griswold appeared on behalf of the Student and Attorney Michael McKeon appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is 11/30/18. An evidentiary hearing was scheduled for 11/6/18.

On 10/29/18, Attorney Griswold reported to the Hearing Officer that she would like to withdraw the subject due process complaint without prejudice since the parties are in the process of executing a settlement agreement.

ORDER:

The matter is DISMISSED without prejudice.
