A special education hearing in the above-captioned matter was requested by Board of Education (“BOE”) via Letter dated July 12, 2018. [2] A pre-hearing conference was scheduled for July 30. The deadline to mail the final decision and order is August 11. The following issues are identified:

1. Is Board of Education’s evaluation of Student appropriate?

2. If the answer to the above issue is in the negative, is Student’s Parent entitled to an individual educational evaluation at public expense? On July 23, BOE’s Attorney indicated via email that Student’s Parents withdrew their request for an independent educational evaluation at public expense and that BOE therefore withdraws its due process hearing request.

Based on the above facts, the request for due process hearing is dismissed.
