ISSUES:
1. Whether the Board provided the Student FAPE since his enrollment in the District in September 2018?
2. Whether the IEP offered the Student on February 22, 2018 is sufficient to meet the Student’s educational needs?
3. Whether the Student requires placement in a private school program such as the Latham School?
PROCEDURAL HISTORY/SUMMARY:
The Parent brought the Due Process Complaint and Hearing Request on July 10, 2018. The Hearing Officer was appointed on July 11, 2018. A Prehearing Telephone Conference took place on July 16, 2018. Following that conference, an initial hearing was scheduled for September 6, 2018.
On August 28, 2018, the Parent requested a thirty day extension of the mailing date. The Board did not object. The Hearing Officer granted the extension request until October 22, 2018, and continued the hearing until October 3, 2018. The hearing took place on October 3, 2018. Following an off-the-record conference between themselves, the parties came back and on-the-record represented that they reached a settlement agreement. The Parent withdrew the matter without prejudice.
FINAL DECISION AND ORDER:
The matter is DISMISSED
