ISSUES:

1. Did the Board offer an appropriate program for the 2018-2019 school year, including the 2018 Extended School Year, beginning July 1, 2018?

2. If not, is placement at Ben Bronz the appropriate program for the Student for the 2018-2019 school year and should the Board be ordered to place the Student at Ben Bronz for the 2018-2019 school year and refund any tuition paid by the Parents?

3. Is the Student entitled to Compensatory Education?

PROCEDURAL HISTORY/SUMMARY:

The Parent filed the Due Process Complaint and Request for Hearing on August 14, 2018. The Hearing Officer was appointed on August 16, 2018 and conducted a Prehearing Conference on August 23, 2018. The hearing was scheduled for October 18, 2018. On October 16, 2018, the Parents withdrew the Due Process Complaint with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
