ISSUES:

1. Was there a denial of FAPE from May 31, 2016 for the 2015-16, 2016-17, and/or 2017-18 school years?

2. If there was a denial of the FAPE for the schools years listed in paragraph one, are the parents entitled to reimbursement for the costs of Shortridge Academy, Dublin, and True North the private schools and programs selected by the Parents from May 31, 2016 through the end of the 2017-18 school year, including ESY-16, ESY-17 and ESY-18?

3. Are the parents entitled to reimbursement for the costs of the evaluation and addendum completed by Dr. Stone?

4. Are the parents entitled to compensatory education as an equitable remedy commencing May 31, 2016?

PROCEDURAL HISTORY/SUMMARY:

The parents filed the Due Process Complaint and Request for Hearing on May 31, 2018. The Hearing Officer was appointed on May 31, 2018, and a Prehearing Conference was conducted on June 14, 2018. Hearing dates were scheduled for July 23 and July 24, 2018.

The parents, through counsel, notified the Hearing Officer that the parties have executed a settlement agreement and the parents were withdrawing their request for hearing with prejudice as of July 2, 2018.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
