ISSUES:

1. Whether the Board’s occupational therapy evaluation of the Student is appropriate?

2. Are Parents entitled to an independent occupational therapy evaluation at public expense?

PROCEDURAL HISTORY/SUMMARY:

The Board brought its Hearing Request on May 3, 2018. The Hearing Officer was appointed May 4, 2018. A Prehearing Telephone Conference was initiated by the Hearing Officer on May 11, 2018. The line was kept open from 9:28 a.m. to 9:38 a.m.; Neither party, however, participated in the conference call.

On May 11, 2018, at 8:09pm, the Attorney for the Board informed the Hearing Officer that the Parent’s request for an IEE was withdrawn.

On May 16, 2018, the Attorney for the Board confirmed that the Board was therefore withdrawing its petition.

FINAL DECISION AND ORDER:

The matter is DISMISSED
