ISSUES:

1. Was the Individualized Education Program (IEP) offered at the 3/1/18 Planning and Placement Team (PPT) meeting for the 2018-2019 school year appropriate?

2. If not, is placement at Alternative Center for Education (ACE) and tutoring the appropriate accommodations for the Student for the 2018-2019 school year?

PROCEDURAL HISTORY/SUMMARY:

The Student initiated this special education due process case on 3/15/18. This Impartial Hearing Officer was assigned to this case on 3/15/18. A Prehearing Conference was convened on 3/26/18. Nancy Scarduzio appeared on behalf of the Student and Attorney Julie Fay appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is 5/29/18. An evidentiary hearing was scheduled for 5/15/18.

On 5/6/18, Nancy Scarduzio reported to the Hearing Officer that she would like to withdraw the subject due process complaint since the parties finalized a settlement agreement.

ORDER:

The matter is DISMISSED without prejudice.
