ISSUES:
1. Did the Board's 2017-18 IEP deny Student a free appropriate public education?
2. If yes, should the Grandparent/Guardian be reimbursed for tuition and transportation to Westport Day School during the 2017-18 school year?

PROCEDURAL BACKGROUND:
Counsel for the Grandparent/Guardian of the Student filed this Request for Due Process Hearing on February 23, 2018. The Hearing Officer was assigned on February 23, 2018, and a Prehearing Conference was held on February 27, 2018. The Attorney for the Grandparent/Guardian and the Attorney for the Board attended the Prehearing Conference by phone. Hearing dates were scheduled for April 4, 6, and 25, 2018. The deadline for mailing the final decision was set as May 25, 2018. The evidentiary hearing was called to order on April 4, 2018. Both counsel and the Grandparent/Guardian were present for the hearing. Counsel then went on the record to request a short recess in order to discuss a potential settlement of the outstanding issues. The Hearing Officer granted their request. Upon their return, they reported the matter was settled, and a written agreement had been completed and executed by the parties. The parties were offered the opportunity to put the agreement on the record, but chose not to do so. Counsel for the Grandparent/Guardian withdrew her complaint with prejudice. The parties jointly requested that the matter be dismissed by the Hearing Officer with prejudice.
FINAL DECISION AND ORDER:
The case is DISMISSED with prejudice.
