ISSUES:

1. Has the student been denied FAPE for the 2017-18 school year?

2. If so, is the Winston Preparatory School an appropriate placement for the student?

3. Depending on the answers to the foregoing, should the parents be reimbursed for tuition and other costs of the placement at Winston Preparatory School?

4. If there is a denial of FAPE, should the student be provided with compensatory education?

SUMMARY AND PROCEDURAL HISTORY:

Case 18-0158 was commenced by the parents by request received by the Board on October 18, 2017. A prehearing conference was held on October 26, 2017. At the prehearing conference, hearing dates were set for December 5, 2017 and December 7, 2017 and the decision date was determined to be December 29, 2017. The hearing dates were subsequently cancelled and the decision date extended to March 1, 2018.

On February 22, 2017, the undersigned hearing officer was advised by the attorney for the parents that the parties had reached a settlement in the case and the matter should therefore by dismissed with prejudice.

FINAL DECISION AND ORDER:

The matter is dismissed with prejudice.
