ISSUES:

1. Did the district offer an appropriate program to the student in the least restrictive environment?

2. If not, is the day program at Forman School an appropriate placement?

3. If the student should be placed at Forman School, does the student require a residential placement in order to receive educational benefit?

4. Should a speech and language evaluation and comprehensive psycho-educational evaluation be provided?

SUMMARY AND PROCEDURAL HISTORY:

Case 18-0064 was commenced by the parents by request received by the Board on July 31, 2017. A prehearing conference was held on August 9, 2017. At the prehearing conference, a hearing date was set for September 12, 2017 and the decision date was determined to be October 13, 2017.

On August 22, 2017, the undersigned hearing officer was advised by the attorney for the parents that, after having met with the Board for a resolution session on August 16, 2017, the parents had elected to withdraw the instant action without prejudice.

FINAL DECISION AND ORDER:

The matter is dismissed without prejudice.
