ISSUES:

1. Is the Board of Education’s proposed IEP for the Student appropriate?

PROCEDURAL HISTORY:

The Student initiated this special education due process case on June 29, 2017. This Impartial Hearing Officer was assigned to the case on July 6, 2017. A Prehearing Conference was convened on July 17, 2017. Attorney Phillip Cohn appeared on behalf of the Student and Shelley Sheriden and Matt Conway appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is September 12, 2017. An evidentiary hearing was scheduled for September 7, 2017.

On September 6, 2017, the Student reported that the parties had settled the dispute and asked that the request for due process be dismissed without prejudice. The Board of Education consents to dismissal without prejudice.

FINAL DECISION AND ORDER:

It is ordered that the Student’s request is granted and the matter is dismissed without prejudice.
