ISSUES:

1. Whether the Student was offered FAPE for summer 2017 and 2017-2018 school year?

2. Whether the Parents are entitled to reimbursement for their placement of the Student at Kildonan for the 2017-2018 school year?

3. If a violation is found, what is the appropriate remedy?

PROCEDURAL HISTORY/SUMMARY:

The Parent, through counsel, filed the Due Process Complaint and Request for Hearing on June 7, 2017. The Hearing Officer was appointed on June 9, 2017, and conducted a Prehearing Conference on June 29, 2017. Hearing dates were scheduled and noticed. The mailing date was extended to September 20, 2017 to accommodate mediation. The date was further extended to September 29, 2017 so that the parties could finalize their settlement agreement. On September 21, 2017, counsel for the Parent withdrew the due process request without prejudice.

FINAL DECISION AND ORDER:

In light of the above, the matter is DISMISSED.
