ISSUES:
1. Does the Student meet the requirements to be exited from the Board’s school? If not;
2. Should the Student attend Gateway Step Forward, his transitional program, to receive a free and appropriate public education (FAPE)?
SUMMARY AND PROCEDURAL HISTORY:
The Student has been identified with Speech or Language Impaired and is entitled to receive FAPE as defined in the Individuals with Disabilities Education Improvement Act (IDEA) 20 U.S.C. §1401 et seq. and Connecticut General Statute §10-76a et seq. At the planning and placement team (PPT) meeting, the Parent objected to the exiting of the Student. The Parent requested that the Student remain in the transitional program. The Board refused the Parents’ request.
On June 7, 2017, the Board received notice of the Parents’ request for due process. An impartial hearing officer was appointed on June 8, 2017 and a pre-hearing conference was held on June 20, 2017. The parties agreed to a mediation session. The mediation session date was July 11, 2017.
In an electronic transmission, the Parent’s attorney withdrew the matter without prejudice. There was no objection by the Board. The mailing date for the Final Decision and Order is August 21, 2017.
FINAL DECISION AND ORDER:
THE MATTER IS DISMISSED WITHOUT PREJUDICE.
