ISSUES:

1. Whether an out of district placement, rather than the placement offered by the Board, is necessary to provide the Student FAPE for the 2017-2018 school year?

PROCEDURAL HISTORY/SUMMARY:

The Parent, through counsel, filed the Due Process Complaint and Request for Hearing on May 25, 2017. The Hearing Officer was appointed on June 2, 2017, and conducted a Prehearing Conference on June 15, 2017. One day of hearing was convened on August 31, 2017. Prior to the next scheduled hearing date, the parties reported that the matter had settled, but they needed time to finalize the agreement. Extensions of the mailing date were provided for this purpose, as requested by the Parent with consent of the Board. On November 2, 2017, the Parents confirmed that the matter was withdrawn and the settlement agreement had been executed.

FINAL DECISION AND ORDER:

In light of the above, the matter is DISMISSED.
