ISSUES:
1. Did the Board commit procedural violations?
2. Did the Board offer an appropriate program for the 2014-2015 (including ESY), 2015-2016 (including ESY), 2016-2017 school years?
3. If not, should the Board be ordered to provide the services enumerated in the Due Process Complaint and reimburse Parents for their expenses for tutoring for the summer of 2016?
4. Do the circumstances warrant an award of compensatory education?
PROCEDURAL HISTORY/SUMMARY:
The Parents filed the Due Process Complaint and Request for Hearing on May 9, 2017. The Hearing Officer was appointed on May 16, 2017 and conducted a Prehearing Conference on May 30, 2017. The parties agreed to engage in mediation and at the request of the parties, the mailing date of the Final Decision was extended to August 18, 2017. The hearing was scheduled for August 11, 2017. On July 31, 2017, the Parents’ attorney reported that the parties had settled their agreement and that the Parents were withdrawing the Due Process Complaint with prejudice.
FINAL DECISION AND ORDER:
The matter is DISMISSED with prejudice.
